What Are the Penalties for Subsequent DUI Offenses in Georgia?
Georgia considers it a DUI offense if a person's blood alcohol content (BAC) is .08 percent or higher, or if a driver is impaired by drugs. If the driver is underage, then they only need a .02 percent BAC to be charged. A commercial vehicle driver needs only a .04 percent BAC to be charged. If you have already been convicted of one of the above drugged or drunk driving charges within the past 10 years and are facing DUI charges again, the stakes are even higher this time around.
For a 2nd DUI offense, you could face:
- 90 days to a full year in jail
- $600 to $1,000 fines
- At least 30 days of community service
- Probation
- Substance abuse treatment
- Surrendering of your license plates*
For a 3rd DUI offense, you could face:
- 120 days to a full year in jail
- $1,000 to $5,000 in fines
- At least 30 days of community service
- Substance abuse treatment
- Forfeiture of your vehicle**
*If someone is convicted of a second DUI within five years, then they also forfeit their driver's license plates. **If there is a third DUI conviction, then a court can order that the vehicle itself be seized and sold off.
For a 4th DUI and beyond, you could face:
- Felony charges
- 1 to 5 years in prison
- Up to $5,000 in fines
- Weeks or months of community service
- 10 years of driver's license suspension
